PRIVACY NOTICE FOR PARTICIPANTS TO THE MAURICE LACROIX COMPETITION FOR THE MAURICE LACROIX RUNNING CLUB ON STRAVA PLATFORM

At Maurice Lacroix SA (hereinafter also referred to as “Maurice Lacroix”, "we", "us" or "our") we are committed to respecting and safeguarding your privacy by handling your personal data responsibly and in accordance with applicable laws.

 

  1. 1.         Data processing.

We wish to inform you that the personal data you provided us with on the occasion of your registration on the Maurice Lacroix Competition Registration web page (hereinafter the "Registration Page"), for the purpose of participating in the Maurice Lacroix competition organized by us for the participants of the Maurice Lacroix Running Club on STRAVA platform (hereinafter, the "Competition"), will be processed by Maurice Lacroix SA, with registered office at Rue des Rangiers 21, 2350 Saignelégier, Switzerland (hereinafter the "Company") in its capacity as Data Controller.

Your personal data will be processed in manual, paper or electronic format and will be stored in our cloud based system which is located in Germany and accessible only to authorized personnel.

We implemented technical and organizational measures to protect your personal data against accidental or unlawful destruction, loss or alteration and unauthorized disclosure or access to your personal data. These measures include training of our personnel who may have access to your personal data.

We will retain your personal data for as long as it is necessary for the fulfillment of the purposes set out in this Privacy Notice, unless a longer or shorter retention period is required or permitted by law.

 

  1. 2.         Purpose of the processing and legal basis

Your personal data are collected and processed by the Company for the following purposes:

  1. to manage your registration on the Registration Page and your participation in the Competition as well as for related administrative purposes;
  2. to fulfill the legal obligations to which the Company is subject or in case the processing is necessary for the protection of our rights;
  3. subject to your explicit consent, for global or local marketing purposes (to send you marketing communications containing news, information and updates about our products and services, offers, promotions and special events, and other marketing communications that may be of interest to you by SMS, email or telephone), and for customizing your experience with us to your interests and shopping habits (e.g., targeted communications) and improving our services, notably via profiling.

The processing mentioned under points (A) and (B) above is based on our legitimate interest and does not require your consent.

The processing mentioned under point (C) above is subject to your express consent.

Providing your personal data is voluntary for all the purposes mentioned above. Please note, however, that without your personal data, (i) you will not be able to register on the Registration Page, to take part in the Competition and to receive relevant prizes; and (ii) we will be unable to provide you with the information and services described under point (C) above.

 

 

  1. 3.         Who may have access to your personal data and why?

Your data may be disclosed to third-party companies responsible for carrying out the processing activities referred to in point 2 above as well as to our affiliated companies or our business partners providing services on our behalf, such as for technical support, for marketing purposes or other types of service delivery.

We have contracts in place with these parties to ensure that personal data is processed based on our instructions and in compliance with this Privacy Notice and any other appropriate confidentiality and security measures.

We only share your personal data with the parties mentioned above and other third parties, including governmental authorities, within the scope of the relevant legal basis and as far as this is reasonably necessary for the purposes as outlined in this Privacy Notice.

 

We may share personal data about you, as necessary in the case of a reorganization or divestiture of our business through sale, merger or acquisition, to protect your, our, or others’ rights, property or safety, to maintain the security of our services or if we are required to share your personal data to comply with applicable laws, court or other governmental regulations, or if such disclosure is otherwise necessary for support of any legal or criminal investigation or legal proceeding.

 

Please note that Maurice Lacroix companies and subsidiaries, as well as authorities, customers and suppliers to whom we may disclose your personal data, may be located outside of your country of domicile, whose data protection laws may differ from those in the country in which you are located. In such cases, we will ensure that appropriate safeguards are in place to protect your personal data by implementing appropriate legal mechanisms, such as EU Standard Contractual Clauses.   1. 4.         What rights do you have in respect to your personal data?

 

You have the right to request information on what personal data we hold about you and to request the correction or deletion of your personal data that is held by a third party with whom we conduct business or by us. Also, you have the right, under certain circumstances, to object to the processing of your personal data, where such processing is based on our legitimate interest and to request the restriction of the processing of your personal data. Further, you have a right to data portability and the right to lodge a complaint to your supervisory authority. If the processing is based on your consent, you have the right to withdraw your consent at any time. Please note that the withdrawal of consent will not affect the processing which has already occurred. Also, please note that these privacy rights are not absolute, and we reserve the right to enforce the restrictions imposed by law.

 

To make such a request, please contact us as described under point 6 below. After providing proof of identity, we will respond to your requests within one (1) month.
